Decision SummaryOn 22 August 2013 the Authority made a decision to cancel the Agent’s registration as a registered migration agent.

Following the Authority’s investigation of two complaints, the Authority was satisfied that the Agent had breached the following clauses of the Code of Conduct for registered migration agents: Clauses 2.1, 2.3A, 2.4, 2.8 and 2.23.

In summary, the Authority was satisfied that the Agent:

  • forged his clients’ signatures on skills assessment application forms;
  • failed to act in accordance with his clients’ instructions, and lodged applications to a skills assessing body without his clients’ knowledge, consent or authority;
  • provided a poor standard of assistance to clients at considerable cost to those clients; and
  • failed to take all reasonable steps to maintain the reputation and integrity of the profession as his conduct was designed to enable international students to obtain fraudulent positive skills assessments and visas under the General Skilled Migration Visa Program.

The Authority further found that the Agent is not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.

In accordance with section 292 of the Migration Act 1958 (Cth), a registered migration agent who has had their registration cancelled must not be registered within 5 years of the cancellation.
