The Department of Immigration & Citizenship will be implementing a recommendation of the Knight Review to remove the mandatory cancellation of Student visas relating to unsatisfactory attendance, progress and working in excess of hours allowed (Knight Review Recommendations 24 and 25):
The Immigration and Citizenship Minister will have the discretion to consider the circumstances of the student and to decide if cancellation is warranted based on the merits of the case put forward (relevant amendments have been made to the Act and the Education Services for Overseas Students Act 2000).
These changes will take effect from 13 April 2013.
